1. Agreement to these Terms
These Terms of Service (the “Terms”) govern your access to and use of booty.cards, including the website, the pack-opening experience, and every related feature (together, the “Service”). The Service is operated by LEGAL ENTITY NAME, of REGISTERED ADDRESS (“we”, “us”, “booty.cards”).
By accessing or using the Service you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
Section 22 contains a binding arbitration agreement and a class action waiver. It affects how disputes between you and us are resolved. Please read it.
2. Who may use booty.cards
To hold an account and use the Service, you must:
- be at least 18 years old, and old enough to form a binding contract where you live;
- not be located in, ordinarily resident in, or accessing the Service from a jurisdiction where it is unlawful for us to offer it — currently any jurisdiction that prohibits paid randomised prize draws, and any country or region under comprehensive U.S. sanctions;
- not be subject to economic sanctions, and not appear on any restricted-party or specially-designated-nationals list;
- use the Service for yourself, on one account, and not on behalf of anyone else.
Each time you use the Service you represent that all of the above is still true. We may ask you to verify your identity, age, or location, and may restrict or close your account if you cannot or will not.
3. What booty.cards is — and is not
booty.cards is an entertainment product. You open packs; each pack awards one professionally graded collectible trading card, held in a vault and represented by a digital token in your wallet. You may keep the card in the vault, redeem it and have the physical card shipped to you, or sell it.
We operate the interface. Collector Crypt Inc. (“Collector Crypt”) sources, authenticates, grades, vaults, draws, and ships the underlying cards, and mints and burns the tokens that represent them. Your use of those parts of the Service is also governed by Collector Crypt’s own terms. Where their terms and ours conflict as to the cards, the vault, or redemption, theirs control.
To be explicit about what we are not:
- Not a custodian. We never take physical possession of a card. Custody sits with Collector Crypt and its vaulting partners.
- Not a broker, dealer, exchange, or market maker. We do not buy your cards, sell you ours, or take the other side of your trades.
- Not an insurer. Nothing on the Service is an insurance policy or a promise to indemnify you against loss in value.
- Not a financial adviser. Nothing on the Service is investment, tax, or legal advice.
- Not a bank or money transmitter. We do not hold, transmit, or exchange your money — see Section 5.
4. Early access
booty.cards is in early access, and play is real. When you open a pack you pay its price in USDC from your own wallet, Collector Crypt draws the card, and a token for that graded card is delivered to your wallet. Those payments, draws and tokens are not simulated and are governed by the rest of these Terms.
Because the Service is in early access, features may be incomplete, may change, or may be withdrawn, and some may be unavailable at times. Where a screen is clearly marked as a demonstration or as play money, the balances on it are not real currency, have no cash value, and are not redeemable, transferable, or withdrawable.
5. Your wallet — we never hold your funds
The Service is non-custodial. You connect a self-custodial wallet (such as Phantom), or a wallet created for you by our embedded-wallet provider, and you retain control of it. We do not hold, custody, control, or have access to your funds or your cards at any time. There is no booty.cards account balance, and consequently there is nothing for us to freeze, lend, or pay out.
Because you hold the keys, you are solely responsible for:
- the security of your wallet, seed phrase, private keys, and devices;
- every transaction you sign, including its price, network, and destination;
- the consequences of losing access. We cannot recover a lost wallet, reverse a signed transaction, or restore assets sent to the wrong address.
Tell us immediately at support@booty.cards if you believe your account has been used without your permission.
6. Packs, odds, and how a card is drawn
Each pack displays its price and its published drop rates before you open it. The draw selects one card from the pool for that pack according to those published rates. We describe exactly how this works, and exactly what we do and do not claim about it, on the Odds & Fairness page — that page is part of these Terms.
- Every pack awards a card. There is no outcome in which a pack is opened and nothing is awarded.
- The price you are shown is the price you pay. If the price of a pack changes between the moment it is quoted to you and the moment you confirm, the transaction is rejected and re-quoted. You are never charged more than the figure you confirmed.
- The pool changes. Cards leave the pool when they are drawn and may return to it. Published rates and any figures derived from the pool describe the pool at the time they are shown.
- Availability is not guaranteed. We may pause packs, retire them, change their price or contents, or stop offering them entirely.
7. Packs are purchases
Opening a pack is a purchase: you pay the price shown and receive one graded card selected at random by Collector Crypt at the rates published on the Odds & Fairness page. There is no free method of opening a pack.
If booty.cards offers raffles, a raffle is a separate promotion with its own free method of entry and its own Official Raffle Rules, published with the raffle. Nothing in this Section offers a free entry to anything else.
8. Payments, and finality
Pack purchases are settled from your wallet at the time you sign the transaction. Prices are shown in the currency stated at checkout and may change at any time before you confirm. You are responsible for network fees.
Transactions settle on a public blockchain and are irreversible. Once a transaction is confirmed, it cannot be undone, cancelled, charged back, or refunded by us or by anyone else. All sales are final, except where a refund is required by law that cannot be waived.
9. Your card: ownership, custody, redemption and shipping
When you are awarded a card, a digital token representing that specific physical card is delivered to your wallet. Holding the token is what establishes your claim to the card. The physical card itself stays in a vault operated by Collector Crypt or its vaulting partners.
Redeeming
You may ask for the physical card at any time. Redemption burns the token and instructs the vault to ship the card to you. You pay the applicable withdrawal fee, shipping and handling, duties, and any sales or import tax. Delivery estimates are estimates, not commitments.
Custody and risk
Storage, insurance, condition, authentication, and shipping of the physical card are handled by Collector Crypt and its vaulting and carrier partners under their terms. We do not take physical custody of any card and we are not responsible for loss, theft, damage, delay, mis-delivery, or destruction in storage or in transit. Your claims in respect of the physical card lie against those parties.
You must give and keep current an accurate shipping address. We are not responsible for a delivery that fails because the address you gave was wrong, incomplete, or out of date.
10. Selling back and secondary sales
The Service may show you an offer to sell a card back immediately, and may let you list a card for sale, receive offers on it, or run it as an auction with bids from other users.
booty.cards does not operate, fund, or act as counterparty to any buyback, instant sell-back, or secondary sale. Those offers are made and settled by independent third-party liquidity providers and marketplace participants. We are not a dealer, market maker, clearing house, or party to your transaction, and we are not liable for it.
The standing sell-back offer
Any percentage, offer, or window shown is that third party’s offer on those terms at that moment. It is not a floor, a guarantee, a redemption right, or a promise by us. Offers may change or be withdrawn, and liquidity may be unavailable entirely.
Listings, offers and auctions between users
Where the Service lets users trade with each other, the contract of sale is between the buyer and the seller. We provide the venue and the record-keeping; we do not verify either party, and we do not guarantee that a listing will sell, that an offer will be honoured, or that any particular price will be reached.
- Bids and offers are binding while they stand. If you place a bid or make an offer you must honour it if it is accepted or wins, unless you withdraw it before that happens and the Service allows withdrawal.
- Auctions settle automatically. When an auction ends, the highest bid at or above any reserve wins, and settlement runs without further action by either party. If the reserve is not met, the card returns to the seller and no sale occurs.
- A seller’s reserve is hidden. You are told only whether the reserve has been met, never what it is. Bid accordingly: a bid can be the highest and still not win.
- Your username and avatar are shown to other users alongside any listing, offer, or bid you make. See Section 6 of the Privacy Policy.
- Completed trades are final for the same reason purchases are — see Section 8.
- Disputes are between the parties. We may, but are not obliged to, help resolve them, and we may reverse or cancel a trade where we find fraud, manipulation, or a pricing error.
Bidding on your own listing, coordinating with others to move a price, and using multiple accounts to trade with yourself are all prohibited under Section 15.
Where a fee applies to a sale made through the Service, we will disclose it before you confirm.
11. Values and vault value
“Vault value” means our estimate of a card’s market value, derived from third-party pricing, population, and sales data for that card in that grade. It is displayed to help you understand what you are looking at.
Vault value is an estimate, not an appraisal, not a guarantee, not a promise of resale value, and not an insured sum. It is not backed by any insurance policy and confers no right to be paid that amount by anyone.
Third-party data may be incomplete, delayed, or wrong. Collectible prices move, and can move sharply. Verify anything that matters to you with an independent source before acting on it.
12. Not investments
Cards and the tokens representing them are collectibles, acquired for entertainment. They are not investment products, securities, or financial instruments, and you agree not to use the Service for investment purposes. They have no intrinsic value; what anyone will pay for them is set entirely by demand and can fall to nothing. We make no promise that any card or token will hold any value.
13. Taxes
You are solely responsible for determining, reporting, and paying any tax arising from your use of the Service, including on prizes, sales, and redemptions. We may report and withhold where the law requires it. Prizes may be taxable income to you.
14. Playing responsibly
Opening packs is designed to be fun and it should stay that way. Spend only what you would be comfortable losing entirely, and treat every rip as entertainment rather than as a way to make money.
If play has stopped feeling good, contact us at support@booty.cards and we will close your account. We may also limit or close an account ourselves where we have concerns about a participant’s wellbeing.
15. Acceptable use
You agree not to:
- break the law, or use the Service to launder money or finance crime;
- misrepresent your age, identity, or location, or use a VPN or proxy to defeat a geographic restriction;
- hold more than one account, create accounts for others, or take part through automated means, scripts, or bots;
- exploit a bug, pricing error, or defect rather than reporting it, or manipulate odds, pools, offers, or free-entry mechanisms;
- bid on your own listing, trade with yourself through a second account, or coordinate with anyone else to move a price or create a false impression of demand;
- scrape, mine, or bulk-extract data from the Service, or resell or redistribute it. Our underlying pricing data is licensed to us and we cannot sub-license it to you;
- attack, probe, overload, or attempt to gain unauthorised access to the Service or any related system;
- infringe anyone’s intellectual property, or impersonate any person or organisation.
16. Suspension and termination
You may stop using the Service and close your account at any time. Closing your account does not affect your wallet or anything already in it.
We may suspend or close your account, withhold a prize, or refuse a transaction where we reasonably believe you have breached these Terms or the Official Rules, where we are required to by law, or where we suspect fraud or abuse. Sections that by their nature should survive termination do survive it.
17. Intellectual property
The Service, including its design, artwork, text, and software, belongs to us or our licensors and is protected by intellectual property law. We grant you a personal, revocable, non-transferable licence to use the Service for its intended purpose. Everything not expressly granted is reserved.
Owning a card or a token does not give you any right in the intellectual property depicted on the card. Pokémon and related marks are the property of The Pokémon Company International, Nintendo, Creatures Inc., and GAME FREAK Inc. PSA, BGS, CGC, SGC, and TAG are the property of their respective grading companies. All other marks belong to their owners.
booty.cards is an independent product. We are not affiliated with, endorsed by, sponsored by, or in any partnership with The Pokémon Company International, Nintendo, Wizards of the Coast, any grading company, eBay, PriceCharting, or any marketplace named on the Service.
18. Third-party services and blockchain risk
The Service depends on things we do not control: Collector Crypt, vaulting and carrier partners, wallet providers, payment processors, data providers, and public blockchain networks. We do not control and are not responsible for their acts, omissions, availability, or terms.
You accept the ordinary risks of using blockchain technology, including network congestion, fees, forks, outages, protocol changes, smart-contract defects, and the irreversibility of confirmed transactions. We are not responsible for losses arising from any of them.
19. Disclaimers
The Service is provided “as is” and “as available”, without warranty of any kind, express or implied. We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that any data, valuation, or estimate shown is accurate or current, or that any defect will be corrected. Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you.
20. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profit, revenue, data, goodwill, or anticipated saving, however caused. Our total liability to you for all claims arising out of or relating to the Service is limited to the greater of the amount you paid us in the three months before the event giving rise to the claim, or one hundred US dollars.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for fraud, for fraudulent misrepresentation, or for death or personal injury caused by negligence. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
21. Indemnification
You agree to indemnify and hold harmless LEGAL ENTITY NAME, its affiliates and partners (including Collector Crypt), and their officers, directors, employees, and agents from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of your use of the Service, your breach of these Terms or the Official Rules, or your violation of any law or third-party right.
22. Disputes, arbitration, and class action waiver
Please read this section carefully. It requires most disputes to be resolved by individual binding arbitration rather than in court, and it waives your right to a jury trial and to participate in a class action.
Talk to us first
Before starting a formal proceeding, send a written description of the dispute and the relief you want to legal@booty.cards. We will try to resolve it informally. If it is not resolved within 60 days, either of us may begin arbitration.
Arbitration
Any dispute arising out of or relating to these Terms or the Service that is not resolved informally will be settled by final and binding arbitration administered by the American Arbitration Association, seated in Nashville, Tennessee, conducted in English before one arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
This does not stop either of us from bringing an individual claim in small-claims court, or from seeking urgent injunctive relief in court to protect intellectual property or prevent unauthorised access.
Class action waiver
Claims may be brought only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court and the rest of this section still applies.
Opting out
You may opt out of this arbitration agreement by emailing legal@booty.cards within 30 days of first accepting these Terms, stating your name and that you are opting out. Opting out affects nothing else in these Terms.
23. Governing law
These Terms are governed by the laws of the State of Tennessee, without regard to its conflict-of-law rules. Anything not subject to arbitration is subject to the exclusive jurisdiction of the courts of Davidson County, Tennessee. If you are a consumer, you keep the benefit of any mandatory protections of the law where you live.
24. Changes to these Terms
We may change these Terms. When we do, we will update the date at the top of this page, and for material changes we will give reasonable notice through the Service before they take effect. Continuing to use the Service after a change takes effect means you accept the updated Terms. If you do not accept them, stop using the Service.
25. General
- Entire agreement. These Terms, the Privacy Policy, the Official Rules, and the Odds & Fairness page are the whole agreement between us about the Service.
- Severability. If any provision is held unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not assign these Terms. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither of us is liable for a failure to perform caused by events beyond reasonable control.
- No third-party rights. Except for the parties we say are indemnified or protected, these Terms create no rights for anyone else.
